1. How to notify Hydro Rubber of product failure.

1.1 The consumer shall forthwith notify Hydro Rubber Cape Town of the claim providing full details thereof and shall set out the basis why Hydro Rubber is liable in terms of the Product Guarantee. 

1.2 Hydro Rubber shall be entitled to inspect the alleged Product Failure or Defect, and to perform any tests in respect thereof, and may do so either itself or by means of any person nominated by it.

1.3 Prior to such inspection and/or testing, the consumer shall not be entitled to perform any repairs to or remove or tamper with any part of the coating.

1.5 The consumer shall provide such further information as Hydro Rubber may require, including but not limited to details of environmental factors, inspection, and repair records.

Hydro Rubber (Pty) Ltd. hereby guarantees that the Hydro Rubber used as a waterproof coating has been applied by a duly authorized applicator in accordance with the manufacturer’s recommendations and is free from defect.

Any water penetration must be reported, in writing, within 30 days upon discovery, to Hydro Rubber (Pty)Ltd, by means of email: info@hydrorubber.info

2. Conditions of Guarantee

 

2.1 Any and all Hydro Rubber products, rainwater gutters and outlets must be regularly maintained and with the understanding that a service coat being applied by one of our approved applicators after a 5-year period - at the cost of the client.

 

2.2 Hydro Rubber, its agents or representatives must be allowed access to inspect the area where the product alleged to be defective.

 

3.3 Full payment for the product and the application of the product must be received, for this guarantee to be in place.  Non-payment or partial payment , will render the 10-year product guarantee invalid and voided.

 

2.4 The limit of liability on any one project is equal to the cost of material and application.

 

2.5 In any event and notwithstanding anything contained in this guarantee in no circumstances shall Hydro Rubber or its applicator be liable, for any increase in costs and expenses, for any loss of profit, business, contracts, revenues, or anticipated savings or for any special, indirect or consequential damages of any nature whatsoever.

 

2.6 Hydro Rubber (Pty) Ltd will not be liable for any defects arising from defective and / or negligent applications of any Hydro Rubber Products.

 

2.7 This guarantee will be rendered invalid should any of the areas to which the product has been applied by has been affected by any act, or failure to act, by any parties other than Hydro Rubber or its applicator where the premises upon which the product has been used has itself been used for purposes which render the area upon which the product has been applied unsuitable for the use of the product.

 

2.8 This guarantee will be rendered invalid if alterations i.e. Solar panels or water geysers have been installed on the roof after the roof was sealed by Hydro Rubber (Pty) Ltd or any of its applicators.

 

2.9 Hydro Rubber aims to provide a product that is colour fast, but due to fluctuating UV rays Hydro Rubber will not be held responsible for colour differences and colour changes in coatings. Should Hydro Rubber Pty Ltd or its Applicator repair a product failure and there is a colour variance between the previous applied product and the product used to repair the product failure.  Hydro Rubber will offer a additional layer to cover the whole of the roof, at cost price – at the cost of the client – Quotation to be submitted to the client for approval.

 

3. Hydro Rubber is not liable for, and the Quality Guarantee specifically excludes all

Product Failures or Defects that result from:

 

3.1 Causes beyond the control of Hydro Rubber including without limitation welding or other heating, mechanical damage, hydrostatic pressure, electrical or electrolyte damage, incorrect cleaning or incorrect use, neglect, explosion, radiation, environmental pollution, vandalism, fire, flood, windstorm, other adverse weather or Acts of God or other accidents or other malicious damage, or the use of any product not manufactured Hydro Rubber.

 

3.2 The deterioration of any metal as a result of any form of electrochemical action (rusting);

 

3.3 Damage to the coating arising from deterioration or movement of the substrate or roof structure, caused by any other substrate or condition including, but not limited to structural cracks, plaster cracks, rising dampness, moisture ingress, or dampness as a result of earth-retention.

 

3.4 This guarantee specifically excludes any damage caused by hail, lightning, trees, damage caused by lack of maintenance & gutter maintenance
